Terms and Conditions
	To be an authorized affiliate of Scar Decals, you agree to abide by the terms and conditions contained in this agreement. Please read this agreement carefully before registering and using the Scar Decals service as an affiliate. By signing up for the Scar Decals affiliate program, you indicate your acceptance of this agreement and its terms and conditions. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND SCAR DECALS. BY SUBMITTING THE ONLINE APPLICATION YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT. Overview. 1. This Agreement contains the terms and conditions in becoming an affiliate in Scar Decals Affiliate Program. The purpose of this Agreement is to allow HTML linking between your web site and Scar Decals web site. All of the graphics, links, and account management will be available to the affiliate at the time acceptance into our program. Please note that throughout this Agreement, "we," "us," and "our" will mean Scar Decals.com , and "you," "your," and "yours" will mean you, the affiliate. 2. Affiliate Obligations 2.1. To begin the enrollment process, you complete and submit the online application. We will review your application to join the program and notify you of your acceptance or rejection. We may decide to decline your application at our sole discretion. 2.2. As a member of our Affiliate Program, you will have access to the ScarAffiliate.com Affiliate Management Center. At this site you will be able to change your affiliate preferences and download HTML code (that provides for links to web pages). Advertisements that we have made available for use in your web site will be available. You must use the HTML code that we provide. 2.3. Only Scar Decals.com's HTML forms are to be used for registration and login to the Scar Decals.com web site. Scar Decals.com reserves the right, at any time, to review your placement and approve the terms and conditions provided to you. 2.4. In no way is the affiliate to use graphics or links not approved by Scar Decals.com. If we update our graphics, we hold it to the affiliates responsibility to update and manage their own links leading to the Scar Decals.com website. All content of the affiliates website including text, banners, links, etc., that lead to any or all of the Scar Decals.com website is the responsibility of the affiliate. 2.5. Scar Decals is not responsible for the creation of the links, which are posted to your site. We may monitor your site, as we feel necessary to make sure that your site is up-to-date and to notify you of any changes to your site that we feel should be made. 3. Rights and Obligations 3.1. We have the right to view your site at any time to determine if you are following the terms and conditions of this Agreement and to alert you of any changes we feel need to be made. We reserve the right to decide to terminate your account in our Affiliate Program at any time for any reason. 3.2. If you should commit fraud, mis-representation, slander, spam email, posts on unapproved sites, or uploading affiliate code through unapproved methods, Scar Decals reserves the right to terminate your participation in our Affiliate Program immediately and without notice to you. Scar Decals will not be responsible for referrel fees should fraud or abuse be detected. 3.3. The term of this agreement will begin upon our acceptance of your Affiliate application, and will continue until notice of termination from you or Scar Decals. 4. Termination At any time and for any reason, either you or we may end this agreement, by giving the other party notice in the form of mail or email. 5. Payment 5.1. For every new user who enters the Scar Decals.com web site through your links from your site and purchases product from Scar Decals.com, we will pay you a commission of 10% of the order subtotal, before tax and shipping. 5.2. Monthly payments will accrue until the minimum of $10 is met. All payouts will be mailed on the 15th of each month. 5.3. Commissions can be voided from reasons such as, declines from a customers credit card or fraudulent orders. In this case, you will be notified immediately. 6. Access to Your Account Center Immediatley after your acceptance, you will be emailed links and given a password so that you may enter our secure Affiliate Management Center. From this site you will be able to manage your account and receive your reports and commissions. 7. Promotions and Limitations 7.1.You are welcome to promote your own web sites, using only html code and approved linking information, but certain forms of advertising are always prohibited. All links and graphics will be provided to you and in no way are links to be used that are not approved by Scar Decals. Junk mail, spam, obscene and indecent advertising are prohibited and we hold the discretion of unlawful use and may close an account at any time for that reason. Any use that we feel may bring disrepute to our company, we have the right to terminate the affiliate. You may use mailings to customers to promote. You must always clearly represent yourself in a respectable way as independent from Scar Decals.com. If you are terminated due to unaccepable advertising, any balances owed to you will not be paid. 7.2. This agreement does not constitute a joint venture, partnership, franchise, or other representative business of Scar Decals. The affiliate is being paid as an independent contractor. 8. Grant of License 8.1. We grant to you a non-exclusive, non-transferable, revocable right to access our site through HTML links solely with the purpose of advertising the Scar Decals website, and to use our logos, links, trade names, trademarks, and similar material. You may not alter, modify or change the Licensed Materials in any way. 8.2. You are entitled to use the licensed materials throughout the time you are an affiliate in good standing. Scar Decals holds sole discretion on how links are used on the affiliates site. You agree to fully cooperate to work with Scar Decals to update and manage your links. 8.3. You grant to us a non-exclusive right to utilize your names, logos and titles in the advertising, marketing, promoting, and publicizing in any manner. However, Scar Decals.com is under no obligation to advertise, market, promote, or publicize. 9. Disclaimer and Limitations of Liability SCAR DECALS WILL NOT BE LIABLE TO YOU TO ANY SUBJECT MANNER SET FORTH FROM THIS AGREEMENT INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST BUSINESS, EVEN IF WE ARE AWARE OF SUCH POSSIBILITIES. IN ADDITION, SCAR DECALS.COM MAKES NO REPRESENTATION THAT THE OPERATION OF ITS SITE WILL BE UNITERRUPTED OR ERROR FREE. IN NO EVENT WILL SCAR DECALS CULMINATE LIABILITY TO YOU TO EXCEED THE TOTAL COMMISSION FEES PAID TO YOU UNDER THIS AGREEMENT. 10. Representations. You represent and warrant that: 10.1. Your web site and all contacts through your web site will be free of any viruses or other computer programming routines that are intended to damage or interfere with any system data. 10.2. You agree that your site does not include promoting sexually explicit obscene or pornographic material or depict violence. 11. Indemnification You agree to indemnify and hold harmless Scar Decals.com and its owners, representatives and affiliates, against any and all claims, suits, actions or other proceedings brought against Scar Decals on or arising from any claim. (i) alleging that our use of any material provided by you infringes on any copyright, patent, trademark, trade secret or other intellectual property right of any third party, (ii) alleging your breach of any third party intellectual property right, misappropriation of any property right or violation of any other third party rights, or (iii) resulting from your breach of this Agreement. Your obligation of indemnity will include payment of any and all judgments, settlements, costs, damages and expenses, including, but not limited to, reasonable attorney fees and costs awarded against or otherwise incurred by Scar Decals or its owners, representatives and affiliates in connection with or arising from any such claim, suit, action or other proceeding. 12. Privacy Your confidentiality is a big concern for Scar Decals. We will not sell, trade, or otherwise give your account information to any party outside Scar Decals. 13. Scar Decals customers who purchase products through Scar Decals.com Affiliate program are customers of Scar Decals. The affiliate will not have access to the customers account information. Scar Decals is responsible for all customer service, processing, shipping and inquiries made by the customer. We may change our policies and operating procedures at any time.
